Arbitration Agreement

YOU AND AGES MORTGAGE AGREE TO RESOLVE ANY CLAIMS, DISPUTES, OR CONTROVERSIES RELATED TO THE TELEPHONE CONSUMER PROTECTION ACT OF 1991 ("TCPA") OR ANY SIMILAR STATE LAWS THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT.

The arbitration will be conducted in accordance with the rules of the American Arbitration Association ("AAA") or another arbitration organization we mutually agree upon. The arbitrator, not a court, will determine the scope of this arbitration provision.

This arbitration agreement is governed by the Federal Arbitration Act ("FAA"). The laws of the State of New Jersey govern the enforceability of this provision.

Class Action Waiver

TCPA-RELATED CLAIMS MUST BE BROUGHT INDIVIDUALLY. NEITHER YOU NOR AGES MORTGAGE MAY JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION, ACT AS A CLASS REPRESENTATIVE, OR PARTICIPATE AS A MEMBER OF A CLASS. BOTH PARTIES WAIVE ANY RIGHT TO A JURY TRIAL FOR TCPA-RELATED CLAIMS.

Other Disputes

All other claims arising under these Terms or from use of the Website shall be resolved exclusively in the state or federal courts located in Morris County, New Jersey, and you consent to the personal jurisdiction of these courts for such purposes.

17. Governing Law

These Terms and any disputes arising from your use of the Website shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.

18. Severability

Any failure by Ages Mortgage to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

20. Entire Agreement
